The decree approved last week by the Junta de Andalucia is seen by many as a means of providing a legal solution to the dozens of thousands of illegally built properties in this autonomous region. In the majority of cases, the ministry for Public Works and Housing proposes "acknowledgement" of these individual properties which would be recognised legally and allow them to find a way out of their current legal 'limbo'.

From Chiclana, where the council is faced with the task of legalising 15,000 illegal houses, town planning delegate, Andrés Núñez, (PP) said the that the decree "is, by any reckoning, complex, ambiguous and contradictory and the most serious thing is that - at first glance - it does not seem to solve the problem of these illegal homes." He added that he thought "the document has obviously been thought up with electioneering in mind."

Junta approves decree to regulate and clarify situation of houses built on 'non-urbanisable' land. The new legislation establishes ways in which houses built on this type of land may be legalised or at least recognised - if possible - by the Planning Law of Andalucia (LOUA).

The PVRE yesterday denounced what it saw as the council's failure to find a consensus when it came to writing up the Provisional Planning Regulations, a document which, the party claims, has been obtained from sources outside the council and which "judging by its content has been written up by staff from the town planning department."

The minister for Public Works and Housing, Josefina Cruz Villalón, has signed a document which will allow new temporary town planning regulations to be enforced. These new rules will be permitted to remain in force for a maximum of two years.

On 2nd November the ChiFRA Management Committee met with the Delegate for Urbanisation, Andres Núñez and the Delegate for Tourism and Foreign Assistance, Stephan Schauer. The meeting was the result of the letter we sent to the Ayuntamiento regarding our change in approach to how we attack the urbanisation and electricity issues.

Chiclana council is currently working towards the appointment of District Councillors in a novel initiative aimed at offering the residents of the town the opportunity to inform the local government of their doubts, complaints and suggestions in a more personalised way.

The Chiclana Mayor, Ernesto Marín, has invited members of the association for those affected by town planning sanctions to apply for them to be blocked. He has also said that the proposals presented by the members will be studied by qualified staff from the Town Planning Department.

This approach is the first step in response to our members request for ChiFRA to adopt a more assertive approach.

Let’s go back to early May this year a couple of weeks before the most recent local elections. The PSOE was in power and had been for a couple of years. There was an Urbanisation Plan (the 2007 PGOU) that had been submitted by the Council which had been through all the local procedures.
